The Supreme Court said that scolding someone cannot be considered as provoking him to commit suicide. Along with this, the court rejected the order of the Madras High Court. In which the hostel warden was held guilty of provoking the student to commit suicide under section 306 of the IPC. The bench of Justice Ahsanuddin Amanullah and Justice Prashant Kumar Mishra said – no one can even imagine that such an incident can happen due to scolding. Actually, the warden had scolded another student on the complaint of a student. After this, the student hanged himself in his room. The warden argued that he had scolded the student as a parent, so that he does not make the mistake in future. The warden had said that there was no personal relationship between him and the student who committed suicide. 2 other cases in which the Supreme Court did not consider it as an incitement to suicide… 1. SC said – harassment cannot be considered as an incitement to suicide In December 2024, the Supreme Court had said that a person can be accused of inciting someone to commit suicide only if there is strong evidence of it. The allegation of harassment alone is not enough for this. In fact, the Gujarat High Court had refused to acquit the husband and in-laws of a woman on charges of harassing her and forcing her to commit suicide. The Supreme Court did not consider breakup as an incitement to suicide The Supreme Court had held in November 2024 that breakup or breaking a promise of marriage cannot be an incitement to suicide. However, a person may get emotionally upset when such promises are broken. If he commits suicide, then no other person can be held guilty for it. In its verdict, the Supreme Court had set aside the verdict of the Karnataka High Court. The High Court held the accused Kamruddin Dastagir Sanadi guilty of cheating on his girlfriend and instigating her to commit suicide. The High Court sentenced the accused to 5 years in prison and a fine of 25,000 rupees. However, the trial court had acquitted the accused.
