A special bench has been formed in the Supreme Court to hear the petitions challenging the constitutionality of the Places of Worship Act- 1991. It consists of CJI Sanjeev Khanna, Justice PV Sanjay Kumar and Justice KV Vishwanathan. This bench will hear the case on December 12 at 3.30 pm. Earlier, this hearing was to be held on December 5. On that day, the bench of CJI Sanjeev Khanna, Justice PV Sanjay Kumar and Justice Manmohan had risen before the hearing. The petitioners include BJP leader Subramanian Swamy, storyteller Devkinandan Thakur, BJP leader and advocate Ashwini Upadhyay, among many others. In the petitions filed by the Hindu side, it has been argued that this law is against the Hindu, Jain, Buddhist and Sikh communities. Due to this law, they are not able to take their own places of worship and pilgrimage sites under their control. Jamiat Ulema-e-Hind has filed a petition against these petitions demanding the dismissal of the petitions of the Muslim Personal Law Board. Jamiat argues that considering the petitions against the Act will lead to a flood of lawsuits against mosques across the country. The Muslim Personal Law Board and the Anjuman Intezamia Masjid Management Committee, which maintains the Gyanvapi mosque, have also sought dismissal of these petitions. Under this, all citizens and non-citizens have equal rights to believe, practice and propagate their religion. The petitions state that the Act takes away this right from Hindus, Jains, Buddhists and Sikhs 2. Article 26
It gives every religious community the right to manage, maintain and administer their places of worship and pilgrimages. The petitions state that the Act deprives them of ownership/acquisition of religious properties (misused by other communities). It also takes away their right to take back property related to their places of worship, pilgrimages and deity. 3. Article 29

Supreme Court lawyer Harishankar Jain filed a petition in the civil court of Sambhal district of Uttar Pradesh on November 19. It claimed that the Jama Masjid of Sambhal was the Harihar temple. The petition was accepted on the same day. The next day the court ordered a survey of the Jama Masjid. 5 days later i.e. on November 24, the team again reached Jama Masjid for the survey. A crowd of people gathered there. 5 people died amid stone pelting and firing. 2 days later, Hindu Sena president Vishnu Gupta claimed that Ajmer Sharif Dargah of Rajasthan was Sankatmochan Mahadev Temple. The court accepted the petition. This process is going on in different parts of the country. Before these cases, cases have been filed regarding Gyanvapi Mosque in Varanasi, Shri Krishna Janmabhoomi-Idgah in Mathura and the mosque in Bhojshala in Dhar, Madhya Pradesh.
