Cases of harassment of Green Card holders are coming to light in America. Customs and Border Protection officers are pressurizing Green Card holders to surrender their Green Cards. Indians are also included in these. Many lawyers dealing with immigration cases told that these Green Card holders are being questioned at airports. They are being kept in custody overnight. Those elderly people are more targeted, who live in America with their children, but go to India in winters. Lawyers have advised that people should not surrender their Green Cards at the airport under any kind of pressure. Green Card holders have the right that their case should be heard in front of an Immigration Judge. A lawyer told that Customs and Border Protection officers cannot cancel anyone’s Green Card unless he surrenders it himself. Lawyer said – Indian elderly are on the target of the officers
According to the report of Times of India, lawyers said that under the Immigration and Nationality Act, if a green card holder stays outside the US for more than 180 days, he has to get re-admission. His card can be cancelled when he stays outside the US for more than a year i.e. 365 days. In such a situation, the cases of such green card holders staying in India are increasing in winter. A lawyer Ashwin Sharma told Times of India that I am seeing many such cases in which such elderly Indians who have stayed outside the US for a little longer are being pressured to sign Form I-407. This form says that the person signing is voluntarily giving up the status of permanent resident (green card). If such people protest, then the Customs and Border Protection officers are threatening them with detention or being sent away. According to USA Facts, from 2013 to 2022, 7.16 lakh Indians have received Green Card in America. In 2022, 1.27 lakh Indians have received Green Card. Apart from these, more than 12 lakh Indian immigrants are in the waiting list for Green Card.
